How to Look Up a Court Case in Boone County?
The Arkansas Judiciary maintains the Search ARCourts portal as the official online tool for locating public case information. This system covers courts using the Contexte Case Management System and allows searches by party name or case number. It is the fastest way to check whether a case exists and to review available case information without visiting the courthouse in person.
For records not available online, or when certified copies or full case files are needed, requests may be directed to the appropriate clerk’s office. The type of case determines which clerk to contact:
- Boone County Circuit Court Clerk — handles civil, criminal, domestic relations, and juvenile cases filed in circuit court, and also serves as the county’s recorder for land and property instruments

Are Court Records Public in Boone County?
The Arkansas Freedom of Information Act (§ 25-19-101 et seq.) establishes the public’s right to inspect and copy court records held by government custodians in the state. Under this law, most Boone County court records are presumed open to the public, and the circuit clerk is required to provide access to those records upon request.

Certain categories of records are exempt from public disclosure under Arkansas law. Records that are withheld from general public access include:
- Juvenile court records
- Adoption records
- Records sealed or expunged by court order — now formally referred to in Arkansas as “Petition and Order to Seal” under current state law
- Grand jury minutes
- Records related to ongoing law enforcement investigations
- Files containing protected medical or health information
- Attorney-client privileged communications
Expunged or sealed records are removed from public view after the court approves the order to seal and the clerk forwards the order to the Arkansas Crime Information Center (ACIC) for record updating. Only parties with court authorization may access sealed files.

The Alpena Department of the Fourth Judicial District Court handles only misdemeanor criminal cases, ordinance violations, and traffic violations. The Harrison Department handles those same matter types as well as civil cases up to $25,000 and small claims up to $5,000.
Criminal case records at the circuit court level can be searched through the Search ARCourts case portal by name or case number. Certified copies of criminal court documents must be requested from the Circuit Clerk’s Office.

Boone County Civil Court Records

The Fourth Judicial District Court — Harrison Department handles civil claims up to $25,000 and small claims matters up to $5,000 involving contracts, recovery of personal property, and property damage.
The small claims division of the Harrison Department is designed to be accessible without legal representation. Under Arkansas Supreme Court Administrative Order No. 18, no attorney may take part in litigating a small claims case on behalf of either party, giving every citizen a direct avenue to present their claim before the court.

Copy fees are $0.25 per page, with a $5.00 certification fee if a certified copy is required. The Circuit Clerk also serves as the ex-officio county recorder under Arkansas Code Annotated § 14-15-402, meaning land records — deeds, mortgages, liens, releases, and surety bonds — are recorded and maintained in this office. Land records from the 1990s forward are available online through the Circuit Clerk’s Online Services portal, with documents from 1997 onward fully imaged and searchable. Land record recording fees are $15.00 for the first page and $5.00 for each additional page.

Boone County Family Court Records
Family law matters in Boone County fall under the jurisdiction of the Boone County Circuit Court, which handles domestic relations cases including divorce, legal separation, child custody, child support, and domestic violence proceedings. The Circuit Court also adjudicates juvenile matters, though those records are largely restricted from public access.
Divorce records are maintained by the Boone County Circuit Clerk. Because divorce is a civil proceeding, divorce decrees and related filings are part of the public circuit court case record. Requests for copies may be submitted in person, by mail, by fax, or by email to the Circuit Clerk’s Office. Copies cost $0.25 per page, and certified copies carry an additional $5.00 fee. Alternatively, divorce certificates — as a distinct vital record — can be ordered through the Arkansas Department of Health vital records service.
Marriage licenses in Boone County are issued by the County Clerk’s Office on Mondays, Wednesdays, and Fridays from 8:30 a.m. to 3:30 p.m. No appointment is required. Both parties must appear in person with valid original photo identification — a driver’s license, state ID, military ID, or passport. The marriage license fee is $55.00, cash only. Licenses are valid for 60 days from the date of issuance. Certified copies of previously issued marriage licenses may be obtained from the County Clerk’s Office for $5.00 by mailing a written request that includes the names of both parties, the approximate marriage date, a contact phone number, a $5.00 money order payable to the Boone County Clerk’s Office, and a self-addressed stamped envelope.

Marriage records dating back to 1869 are maintained in the County Clerk’s Office. Marriage certificates are also available through the Arkansas Department of Health for $10.00 per copy.
Birth and death records for Boone County events are not held at the county level. The Arkansas Department of Health, Vital Statistics Division in Little Rock is the custodian of these records. Birth records are available from February 1, 1914, onward. The fee for a birth certificate is $12.00 for the first copy and $10.00 for each additional copy of the same record ordered simultaneously, plus a $5.00 processing fee and a $1.85 identity verification fee. Death certificates cost $10.00 for the first copy and $8.00 for each additional copy, plus the same processing and identity verification fees. Under Arkansas law, death records less than 100 years old are restricted to immediate family members of the deceased, their designated attorney, and authorized government agencies.

Boone County Probate Court Records
In Arkansas, probate jurisdiction is vested in the county court, and in Boone County, the County Clerk — not the Circuit Clerk — serves as the custodian of probate court records. This includes records of decedent estates, wills, guardianships, conservatorships, adoptions (where non-confidential), and civil commitment proceedings.
Probate records in the County Clerk’s office date back to 1869, including some wills on record from 1869 through 1942. This makes the office a valuable resource for both active estate matters and genealogical research.
