Carroll County, Arkansas, operates under a dual-district court structure — an arrangement unique among Arkansas counties — with courthouses in both Berryville (Eastern Judicial District) and Eureka Springs (Western Judicial District). This setup means that court records for a given case may be held at either location depending on where the case was filed, making it important to identify the correct district before submitting a records request. The Carroll County government provides general county information and links to the various offices responsible for maintaining court records.
How to Look Up a Court Case in Carroll County?
Arkansas court records can be accessed through official clerk offices, public terminals at the courthouse, and state-maintained online tools. ArkansasCourts.us offers an orientation to how Arkansas’s court system is organized and can assist users in identifying the right court for a given matter. For direct case lookups, the Arkansas Judiciary operates the Arkansas Judiciary Case Search Portal, which provides public access to case information for courts using the Contexte Case Management System. Searches can be conducted by party name or case number. In-person access to case files and copies of court documents is handled by the Circuit Court Clerk at either the Berryville or Eureka Springs courthouse, depending on where the case was filed.
Are Court Records Public in Carroll County?
The Arkansas Freedom of Information Act (FOIA) establishes a broad right of public access to government records in Arkansas, and most Carroll County court records fall within that framework. However, FOIA access to court records is supplemented and, in some respects, superseded by the Arkansas Supreme Court’s Administrative Order No. 19, which specifically governs access to and confidentiality of court records. Together, these authorities create a presumption that court records are public while carving out defined categories of restricted information.
The following types of records are exempt from public disclosure or carry restricted access:
- Adoption records — sealed by operation of law
- Juvenile court records — confidential under Arkansas statutes
- Grand jury minutes and deliberations
- Classified or ongoing law enforcement investigation information
- Personnel contact information for court employees and judicial officers
- Unpublished drafts of judicial decisions or opinions
- Records sealed by specific court order
- Financial account numbers, Social Security numbers, and other sensitive personal identifiers redacted from public filings
When a record is restricted, the clerk may require requesters to demonstrate their legal right to access it before releasing copies. Persons denied access to a court record may seek review under applicable FOIA and court rules procedures.
