Independence County, Arkansas is a north-central Arkansas county with Batesville as its county seat. The county’s judicial system is built around two courts: the Independence County Circuit Court and the Independence County District Court. Each handles a defined range of civil, criminal, and family matters, and both generate records that are maintained under Arkansas law as part of the public record system.
Arkansas court records can be searched through official state court resources, courthouse clerk offices, public access terminals, and online case databases. Residents looking for case information across all Arkansas counties can start at ArkansasCourts.us, which can help orient users toward the correct court, portal, and record request method for Independence County proceedings.
How to Look Up a Court Case in Independence County?
Two search methods are available for finding court records in Independence County: an online state portal and in-person access at the appropriate courthouse.
Online Search — Arkansas Case Search Portal
The Arkansas Judiciary’s Case Search portal (also called Search ARCourts) provides free public access to case information for courts using the Contexte Case Management System. Searches can be conducted by party name, case ID, or citation number. The system returns case summaries, party listings, hearing schedules, docket entries, offense information, and sentence details where applicable. Not every Arkansas court is integrated into this system, so the Search ARCourts directory can help verify whether a specific Independence County case type is covered.
In-Person Access
Individuals who cannot locate a case online, or who need physical copies of court documents, can visit either court clerk’s office directly during business hours:

Are Court Records Public in Independence County?
Arkansas law presumes that government records — including court records — are open to public inspection and copying. The Arkansas Freedom of Information Act (FOIA) guarantees residents the right to inspect and obtain copies of public records held by Independence County courts during normal business hours. The right of access is codified under A.C.A. § 25-19-105, which establishes that all public records shall be open to inspection and copying unless a specific statutory exemption applies.
The following categories of records are exempt from public disclosure under Arkansas FOIA and are not accessible through Independence County courts:
- Adoption records
- Grand jury minutes and proceedings
- Unpublished drafts of judicial or quasi-judicial opinions and decisions
- Unpublished memoranda, working papers, and correspondence of Supreme Court Justices and Court of Appeals Judges
- Records sealed by judicial order
- Juvenile court records (confidential by operation of law)
Records that are not otherwise restricted may be inspected at no cost. Copy fees are governed by A.C.A. § 21-6-402, which sets the schedule of fees charged by circuit court clerks for certified copies, court filings, summons, and related services. Requesters should contact the relevant clerk’s office to confirm copy fee amounts before submitting a request, as charges can vary depending on the document type and the number of pages involved.
Independence County Criminal Court Records
Criminal jurisdiction in Independence County is shared between the Circuit Court and the District Court, depending on the severity of the charge. Felony cases and Class A misdemeanors are handled exclusively by the Circuit Court. The District Court has jurisdiction over most Class B and C misdemeanors, traffic offenses, and DWI matters.
Criminal court records typically contain the names of charged parties, case numbers, offenses with statute citations, plea and disposition information, sentencing details, and docket history. These records are public unless the case involves a sealed record, a juvenile, or a matter that has been expunged.
